Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cortova platform ("Service") operated by Cortova, Inc. ("Cortova", "we", "us"). By creating an account or signing in, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Cortova is a sales productivity platform — CRM, calling, messaging, scheduling, AI coaching, and related capabilities. We may add, change, or remove features over time. Material changes that reduce functionality you rely on will be communicated in advance when reasonable.
2. Your account
You are responsible for the activity that happens under your account, for keeping your credentials secure, and for the accuracy of the information you provide. You must be at least 18 to use the Service. You may not share a single seat between multiple humans.
3. Your data
You retain all rights to the data you put into Cortova ("Customer Data"). We process Customer Data on your behalf to provide the Service and the AI features you enable. We do not sell Customer Data, and we do not use Customer Data to train third-party foundation models. Customer Data lives in a tenant-isolated workspace and is never shared across customers. 4. Acceptable use
You agree not to:
- Send unsolicited marketing, spam, or any communication that violates the TCPA, CAN-SPAM, GDPR, or other applicable laws.
- Use Cortova to harass, defraud, or harm any person.
- Reverse engineer the Service, probe it for vulnerabilities without authorization, or use it to build a competing product.
- Upload malware, illegal content, or content you do not have the right to share.
- Circumvent rate limits, usage caps, or any technical restriction we apply.
You are responsible for obtaining consent for any recordings, transcriptions, and outbound communications that the Service helps you send, and for complying with applicable do-not-call, do-not-email, and consumer-privacy laws in the jurisdictions where your contacts live.
5. AI features
Cortova includes AI-generated suggestions, summaries, drafts, and coaching ("AI Output"). AI Output is provided as a tool to assist you and can be wrong or misleading. You are responsible for reviewing AI Output before relying on it, sending it to a contact, or making a business decision based on it.
6. Subscriptions and payment
Paid plans are billed through Stripe according to the pricing on cortova.ai/pricing at the time you subscribe. Fees are non-refundable except where required by law. You may cancel at any time; your plan continues through the end of the current billing period. We may suspend the Service for non-payment after reasonable notice.
7. Third-party services
Cortova integrates with third-party services you choose to connect (e.g. Twilio, Microsoft 365, Google Workspace, Stripe). Your use of those services is governed by their own terms; we are not responsible for their availability or content.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially violate these Terms or use the Service in a way that creates legal or security risk for us or other customers. On termination we will, on request, make Customer Data available for export for a reasonable period before deletion.
9. Warranty disclaimer
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Cortova disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI Output will be accurate.
10. Limitation of liability
To the maximum extent permitted by law, Cortova's total liability for any claim arising out of or relating to the Service will not exceed the fees you paid us in the twelve months preceding the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, even if advised of the possibility of such damages.
11. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will give reasonable notice (for example, by email or an in-product banner). Continued use of the Service after the change means you accept the updated Terms.

These Terms are intentionally simple for our pre-pilot phase. We will publish a more detailed Master Services Agreement before general availability; existing customers will receive notice and an opportunity to review before it takes effect.
